Terms and Conditions for the Use of the Web Shop shop.salespro4u.com
§ 1 Scope of Application

1.1. These terms of use govern the contractual relationship between SalesPro4U AG (hereinafter "SalesPro4U") as the operator of the web shop shop.salespro4u.com and the registered users (hereinafter "Experts") in connection with the use of the offered service - regardless of the device or operating system used to access it.

1.2. Deviating terms and conditions of the Expert only apply if SalesPro4U explicitly agrees to them in writing.
§ 2 Subject of the Contract
2.1. SalesPro4U offers a paid subscription (" Expert Memberships", see Section 3.1.) via the web shop shop.salespro4u.com, which include, among other things, inclusion in the SalesPro4U expert database. After successful registration, payment, completion of the onboarding interview, and potential separately booked additional coaching services (“Power Session” and “Coaching Journey”, Section 3.2. and 3.3.) Experts may be proposed to companies for filling open positions through SalesPro4U. The exact scope of any coaching services is defined in the current service description of the selected services. There is no entitlement to placement, introduction to specific companies, or a concrete job placement. No job guarantee is given, and SalesPro4U does not owe any placement success. SalesPro4U supports the Expert through coaching and agreed services in the job search and application process. However, there is no entitlement to successful placement, introduction to specific companies, or a concrete job position. No job guarantee is given, and neither SalesPro4U nor its certified Mentors or Coaches (see Section 8.7.) owe any placement success.

2.2. A current overview of the available Expert Membership, Power Sessions and Coaching Journey and their scope of services is available at shop.salespro4u.com. SalesPro4U reserves the right to modify, expand, limit, or discontinue the service offering as the service evolves, provided that the legitimate interests of the Expert are not unreasonably affected. This does not give rise to any claims for reduction, reimbursement, or compensation. However, the Expert may terminate the Expert Membership for good cause in accordance with Section 10.2. if essential components of the booked services are discontinued during the term.

2.3. SalesPro4U guarantees the highest possible availability of the web shop within technical and operational constraints. Short-term interruptions due to maintenance, security, or system work are reserved. SalesPro4U assumes no liability for outages beyond its control.
​
2.4. Partner offers are - unless expressly stated otherwise - only available to Expert Groups defined by SalesPro4U. Contracts concluded between Experts and external partners are made without the involvement of SalesPro4U. Only the terms and conditions of the respective partner company apply.
​
2.5. SalesPro4U is entitled to inform Experts about its own or partner offers. SalesPro4U may send relevant information to registered Experts via common communication channels (e.g., email, SMS, internal messages, messenger services, social media, etc.).
​
2.6. To facilitate the targeted potential placement of Experts and to provide Mentors or Coaches with the necessary briefing prior to delivering coaching services, the Expert agrees to the applicable Privacy Policy and expressly consents that SalesPro4U may share the Expert’s personal data with selected companies for potential placement purposes, as well as with Mentors or Coaches for the preparation and execution of coaching services, without requiring further approval. SalesPro4U will treat such personal data with the utmost care and in full compliance with applicable data protection laws.

2.7. Job application support by SalesPro4U commences only after successful onboarding, the completion of all booked or included coaching services, and/or the finalization of a Job Application Video (see Section 3.4.). Such support is available exclusively to Experts with an active Expert Membership subscription and is provided only while the subscription remains active.
§ 3 Expert Membership and Coaching Services
3.1. The Expert Membership includes:

Certification as an Expert in the exclusive SalesPro4U Expert Database,

Job application support through SalesPro4U (no guarantee of successful placement), and
-
One complimentary Power Session (offer subject to availability).
The complimentary Power Session becomes available only after four months of active subscription. The minimum subscription period is six months. After this period, the membership may be cancelled by the Expert monthly.
3.2. A Power Session is available as a standalone service or in addition to the Expert Membership. Fees are determined by the applicable price at the time of booking. Each session has a standard duration of 30 minutes and is conducted online via Zoom, unless otherwise agreed in writing.

Rescheduling: One-time rescheduling is permitted if either party provides at least 24 hours’ notice.

Cancellation/No-Show (Expert): If the Expert cancels late or does not attend, the full fee remains due, and no refund will be provided.

Cancellation/No-Show (Coach): If the Coach cancels late or does not attend, SalesPro4U will arrange a rescheduled session at no additional cost to the Expert.

Timeline: SalesPro4U and its Coaches will make every effort to conduct the session within six weeks at the latest.
3.3. A Coaching Journey consists of four individual Power Sessions. It is available as a standalone service or in addition to the Expert Membership. Each session lasts 30 minutes and is conducted online via Zoom, unless otherwise agreed in writing.

Rescheduling and cancellation follow the same policy as set out in Section 3.2.

SalesPro4U and its Coaches will make every effort to conduct the four sessions within six weeks at the latest.
3.4. The Job Application Video is a special service available exclusively to Experts with an active Expert Membership subscription. It is not available to Experts who have only booked standalone Power Sessions or a Coaching Journey.

Creation: The video may be produced from the recording of an additional coaching session or from video material provided directly by the Expert (maximum length: 30 seconds).

Delivery: Upon separate order, SalesPro4U will edit the material into a Job Application Video of up to 30 seconds. Delivery may take up to six weeks in exceptional cases. The final video will be shared with the Expert for formal approval; however, the Expert is not entitled to request major changes.

Fees: The fee for this service is determined by the applicable price at the time of booking and is payable in addition to the cost of any Power Session, where applicable.

Use: After the Expert has approved the final version, SalesPro4U may share the Job Application Video with selected companies for potential placement purposes. The video will not be published publicly and will not be distributed beyond this defined scope.
3.5. By default, all coaching sessions are recorded. The Expert may object to recording at the beginning of a session. Where a recording is made, the Expert shall receive a copy. With the Expert’s consent, recordings may also be used, in whole or in part, to create a Job Application Video in accordance with Section 3.4. SalesPro4U undertakes to process and store all recordings in compliance with applicable data protection laws and with due regard for the Expert’s privacy rights.
§ 4 User Account and General Booking
4.1. Use of the web shop services requires the creation of a user account and the conclusion of a paid subscription. There is no entitlement to membership. SalesPro4U reserves the right to reject memberships without providing reasons.

4.2. Subscriptions and any booking of coaching services may only be concluded by natural persons of legal age and with full legal capacity. Minors are not allowed to subscribe. For legal entities, membership is only permitted through authorized representatives. By completing the order, the Expert confirms compliance with these requirements.
​
4.3. By purchasing a subscription, a usage contract between SalesPro4U and the Expert is concluded. After successful ordering, the Expert receives a confirmation email.
​
4.4. To use the web shop, a user account managed via email address and password is required. The Expert is obliged to treat login credentials confidentially and protect them from third-party access. In case of suspected unauthorized use, the password and access must be changed immediately, and SalesPro4U must be informed.
​
4.5. Multiple registrations by the same Expert are not permitted. User accounts are non-transferable. In case of violations, SalesPro4U reserves the right to block or delete accounts and terminate the contract without notice. Payments already made will not be refunded unless the Expert proves that no or lesser damage occurred.
§ 5 Duties of the Expert
5.1. The Expert is obliged to keep login credentials (username, password) secret and not to share them with third parties.

5.2. The Expert agrees to refrain from actions that could endanger the technical infrastructure, security, or stability of the shop.salespro4u.com service or affect the availability of stored data.
​
5.3. If the Expert is invited by SalesPro4U to a potential Job Interview (“Match-Making Meeting") with a potential company, introductory meeting, or any other coordination appointment - and has agreed to this in writing - is considered a serious placement opportunity.
​
5.4. The Expert agrees to attend the Match-Making Meeting and to prepare appropriately. Cancellation or absence without valid reason may be deemed a breach of contract by SalesPro4U and may result in the immediate termination of the Expert’s membership without refund.
​
5.5. The Expert also agrees to inform SalesPro4U immediately about the outcome of the meeting - especially if it results in a contract offer, collaboration, or continued communication with the company. If a collaboration arises without SalesPro4U’s involvement, SalesPro4U's placement entitlement remains unaffected.

5.6. If the Expert is offered the opportunity to appear in the podcast “The Expert Talk,” the Expert agrees to notify SalesPro4U immediately if the podcast appearance leads to a request or contact from a potential company. This media exposure is also considered a potential placement opportunity under these Terms. SalesPro4U will then take over and support the placement process.

5.7. By participating in the podcast “The Expert Talk” the Expert agrees that the resulting audio and video material may be published, stored, and distributed by SalesPro4U in full, in edited form, or in excerpts. SalesPro4U will present the first edited version to the Expert for approval. After initial approval, no further consent is required for later edits or publications.
§ 6 Suspension, Termination, and Liability of the Expert
6.1. If an Expert breaches contractual obligations, SalesPro4U is entitled to temporarily suspend the account or terminate the contract for good cause in accordance with Section 10.2. In such cases, membership fees already paid will not be refunded. Instead, the amount paid will be retained as lump-sum compensation, unless the Expert proves that no or lesser damage occurred. If the actual damage exceeds the retained amount, SalesPro4U reserves the right to assert further claims.

6.2. Experts whose account has been suspended or contract terminated are prohibited from registering again under another account or through third parties, or from continuing to use the service. In case of temporary suspension, SalesPro4U will notify the Expert by email and lift the suspension automatically after the period ends.
§ 7 Prices and Payment Terms
7.1. The prices applicable to paid subscription and any other coaching services are those stated at the time of booking on shop.salespro4u.com.

7.2. The Expert must provide a valid payment method, e.g., credit card, PayPal account, or another payment method accepted by SalesPro4U.
​
7.3. Any fees are due immediately upon contract conclusion. Late payment begins automatically upon the due date. Invoices and payment notices may be sent via email.
​
7.4. SalesPro4U reserves the right to adjust prices and the scope of services for future bookings at any time. For ongoing memberships, price or service changes may also apply to existing subscriptions. In such cases, SalesPro4U will notify the affected subscribers in advance in accordance with Section 11.3.
​
7.5. Special promotions or discounts only apply to the initial term of the respective membership and not automatically to renewals, unless explicitly agreed otherwise in writing.
​
7.6. Offsetting or withholding by the Expert is only permitted if counterclaims are acknowledged by SalesPro4U or legally established.
​
7.7. Payments via external payment service providers (e.g., PayPal) are subject to their terms and conditions. These providers are named under the link "External Payment Providers." In the event of unjustified chargebacks, claims may be assigned to the respective payment provider; further clarification will then take place directly between the Expert and the provider.
§ 8 Liability
8.1. SalesPro4U assumes no liability for the accuracy, completeness, or legality of content published or shared by the Expert, including on social networks. These do not reflect the views of SalesPro4U.

8.2. SalesPro4U is only liable for damages caused intentionally or through gross negligence by SalesPro4U, its legal representatives, or agents, as well as for breaches of essential contractual obligations.
​
8.3. For breaches of essential contractual obligations without intent or gross negligence, liability is limited to typical, foreseeable damages - capped at the amount of one annual membership fee.
​
8.4. Liability for damages resulting from injury to life, body, or health, or the assumption of a guarantee, remains unaffected.
​
8.5. SalesPro4U explicitly distances itself from external website content linked on the web shop. The respective provider is solely responsible for such content.
​
8.6. SalesPro4U assumes no responsibility or liability if a company provides incorrect, misleading, or incomplete information to an Expert. Any claims or disputes arising from such circumstances must be resolved directly between the Expert and the company.
​
8.7. Mentors or Coaches may suggest potential companies that might fit the Expert's profile; however, these suggestions are non-binding, and the final decision and responsibility remain with the Expert. Neither SalesPro4U nor its Coaches give any guarantee of employment or successful placement. The Expert remains solely responsible for their career decisions and job search outcomes.

8.8. All communication between the Expert and Mentors or Coaches must be conducted exclusively through SalesPro4U platforms and channels. Direct private contact outside the SalesPro4U framework is not permitted to ensure transparency, quality, and data protection compliance.
§ 9 Data Protection
9.1. Personal data is processed in compliance with applicable Swiss data protection law.
9.2. The current privacy policy available under the link applies.

9.3. The Expert expressly agrees that SalesPro4U may share the personal data provided during the membership (e.g., name, qualifications, professional background, contact details) with interested companies for the purpose of potential placement. This disclosure is made exclusively for this purpose and in compliance with applicable data protection regulations. If data is transferred internationally, appropriate safeguards (e.g., standard contractual clauses) will be implemented.
§ 10 Termination of the Contract
10.1. The duration of a subscription depends on the period selected at the time of booking (e.g., six month). If neither party terminates within the deadline, the membership automatically renews for the same period. Termination is possible at any time at the end of the contract term.

10.2. The right to extraordinary termination for good cause remains unaffected. Good cause includes violations of legal regulations or essential contractual obligations, or actions that significantly damage the reputation of SalesPro4U.
​
10.3. Experts who qualify as consumers under Swiss law have the right to revoke their subscription contract within 14 days of conclusion without giving reasons. To exercise this right, a clear statement (e.g., by email) must be sent to SalesPro4U within the revocation period. Services rendered before revocation may be charged proportionally.
§ 11 Final Provisions
11.1. Changes and additions to this contract must be made in writing. Verbal side agreements do not exist.

11.2. The assignment of claims against SalesPro4U is excluded unless otherwise legally provided.
​
11.3. SalesPro4U reserves the right to change these Terms and Conditions with effect for the future. The Expert will be informed immediately when the changes take effect. If no objection is made within the given deadline, the changes are deemed accepted. This right will be expressly stated in the change notice.
​
11.4. Swiss law applies exclusively, excluding international private law. The place of jurisdiction - where legally permissible - is Fribourg, Switzerland.
​
11.5. Should any provision of this contract be or become invalid, the validity of the remaining provisions remains unaffected. The invalid clause will be replaced by a provision that most closely reflects the intended economic purpose.
